Terms of Service

1. Introduction to Midlife Founder

Welcome to Midlife Founders, operated by Sven Elstermann. These Terms govern the $39 consulting call and any related pages or booking flows you use. By booking, paying for, or attending a call you agree to these Terms and to the Privacy Policy.

 

2. Insanely Simple Agreement

This is a clear and legally binding agreement between you and Sven Elstermann. Please read it carefully. If you do not agree, do not book the call.

 

3. Eligibility

 You must be at least 18 years old. You confirm you have the authority to enter into this agreement and the financial capacity to make the purchase.

 

4. The Service

 A live one to one consulting call of about 30 minutes. Focus is practical guidance tailored to your context. No ongoing support or deliverables are included unless stated here. Any summaries or links shared after the call are a discretionary bonus.

 

5. Booking and Scheduling

You book through the checkout and scheduling flow. Times are managed in Pacific Time. You receive a confirmation email with time, date, and meeting link. You are responsible for joining with a working device and internet.

  

6. Rescheduling, Cancellation, and No-Show

• You may reschedule once at no charge if you do so 24 hours or more before the start time.

• Cancellations more than 24 hours before the start time may be refunded at my discretion.

• Cancellations within 24 hours are treated as completed services and are non refundable.

• A no show or arrival more than 10 minutes late without notice is treated as completed and is non-refundable.

If I need to cancel or reschedule, I will offer a new time as soon as possible. If we cannot find a workable time within 14 days, I will issue a full refund.

  

7. Late Arrival

If you arrive late, the call may still end at the scheduled time. If I arrive more than 10 minutes late, I will extend the call when possible or offer a free reschedule or a refund.

 

8. Price, Taxes, and Payment

Price is 39 USD plus any applicable taxes. Payments are processed by Stripe through Kajabi. The price shown at checkout applies to your purchase. Contact me about billing issues before starting a chargeback. Subscriptions are not part of this offer.

 

9. Recordings

Calls may be recorded only with clear notice at the start. If recorded, I may use the recording for quality improvement or to provide you a replay. Do not share a replay publicly without written permission. If you do not want recording, tell me before the session begins.

 

10. Program Expectations

What I provide 

• Access to the scheduled consulting call.

• Practical guidance, frameworks, and suggestions you can apply.

• Optional short follow up notes at my discretion.

 

What I do not provide 

• Guaranteed business or revenue results.

• Done for you work unless separately agreed.

• Unlimited support or 24 by 7 access.

• Legal, tax, medical, mental health, or investment advice.

 

Your responsibilities 

• Join on time with a stable connection.

• Decide which actions to take after the call.

• Comply with these Terms and with applicable laws.

• Use materials only for your own business.

 

11. Confidentiality and NDA

I treat your information as confidential and use it to deliver the call and related support. I may disclose information if required by law or to prevent likely harm or fraud. No NDA exists unless a separate NDA is signed before the session. 

 

12. Intellectual Property

All materials, frameworks, templates, and recordings are my intellectual property. You get a personal, non transferable license to use them in your own business. You may not copy, share, resell, or republish my materials. You may not use my brand assets without written permission.

 

13. Testimonials and Success Stories

If you share feedback or results by email, message, or on a call, I will seek your clear permission before publishing any testimonial that includes your name, likeness, or identifying details. Anonymous feedback may be referenced in aggregate. To request removal from future marketing materials, email [email protected] and I will make reasonable efforts on a go forward basis.

  

14. Coaching and Professional Advice Disclaimers

The call provides education, coaching, and general information. It is not legal, tax, medical, mental health, or investment advice. I do not diagnose or treat conditions. You are responsible for your decisions and outcomes.

 

15. No Guarantees or Warranties

 I do not guarantee specific income, clients, growth, or outcomes. Results vary based on your implementation, market, and many other factors. The service is provided as is and as available. To the fullest extent allowed by law I disclaim implied warranties including fitness for a particular purpose.

 

16. Acceptable Use

Be respectful and lawful. I may end a session if behavior is abusive or inappropriate. If I end a session for cause, the fee is non-refundable.

 

17. Limitation of Liability

To the fullest extent allowed by law, my total liability for any claim related to a consulting call will not exceed the amount you paid for that call. I am not liable for indirect or consequential damages including lost profits or lost data.

 

18. Force Majeure

I am not responsible for delays or failures caused by events outside my reasonable control such as platform outages, power failures, illness, or severe weather. If affected, I will reschedule or refund.

  

19. Privacy and Data

Your use of the service is also governed by the Privacy Policy posted on my site. That policy explains how I collect, use, and protect personal information.

  

20. Dispute Resolution

These Terms are governed by the laws of the State of California. Courts located in Los Angeles County, California have exclusive jurisdiction, subject to small claims options available to either party. You and I agree to bring claims only in our individual capacities and not as a class action.

 

21. Changes to Terms

I may update these Terms when needed. The updated version will be posted with a new last updated date. Your continued use after changes means you accept the updated Terms.

  

22. Termination

I may refuse or end service if conduct violates these Terms or is harmful to me or others. If I end service for cause, the fee is non-refundable.
