1. Introduction

Welcome to Midlife Founders, operated by Sven Elstermann (“Midlife Founders,” “I,” “me,” or “my”).

These Terms of Service (“Terms”) govern your access to and use of any services, programs, products, websites, content, materials, communities, coaching, consulting, workshops, courses, memberships, digital resources, and related offerings provided by Midlife Founders (collectively, the “Services”).

By purchasing, accessing, using, or participating in any Services, you agree to be bound by these Terms and by the Privacy Policy.

If you do not agree to these Terms, do not use the Services.

 

2. Eligibility

You must be at least 18 years old to purchase or participate in the Services.

By using the Services, you represent that:

Midlife Founders provides educational, coaching, consulting, advisory, and informational services.

Services may include, but are not limited to:

• One on one coaching
• Consulting and advisory sessions
• Strategy reviews
• Accelerator programs
• Group coaching
• Workshops and training
• Courses and digital products
• Memberships and communities
• Templates, frameworks, resources, and recordings
• Email, messaging, and asynchronous support

The specific scope, duration, deliverables, pricing, and access terms for each Service will be described on the applicable sales page, checkout page, proposal, invoice, or written agreement.

 

4. No Professional Advice

The Services are educational and informational in nature.

Nothing provided through the Services constitutes:

• Legal advice
• Tax advice
• Accounting advice
• Investment advice
• Financial advice
• Medical advice
• Mental health treatment
• Therapy
• Any regulated professional service

You are solely responsible for your decisions, actions, and results.

No fiduciary, employment, agency, partnership, or joint venture relationship is created through your participation in the Services.

 

5. No Guarantees

I do not guarantee any specific outcome from participation in the Services.

This includes, without limitation:

• Revenue growth
• Business growth
• Audience growth
• Lead generation
• Client acquisition
• Career advancement
• Productivity improvements
• Any other business or personal result

Any examples, testimonials, case studies, projections, or success stories are illustrative only and do not guarantee future results.

Your results depend on many factors outside my control, including your effort, experience, implementation, market conditions, timing, and circumstances.

 

6. Pricing and Payment

Prices are displayed at checkout or otherwise communicated before purchase.

Payments are processed through third party payment providers such as Stripe, Kajabi, or similar platforms.

You agree to provide accurate billing information and authorize all charges associated with your purchase.

Failure to complete payment may result in suspension or termination of access to the Services.

 

7. Payment Plans

If a payment plan is offered and selected, you remain responsible for all payments due under the agreed payment schedule.

Choosing a payment plan does not reduce your financial obligation.

Failure to use or complete the Service does not eliminate your responsibility to make remaining payments.

I reserve the right to suspend access to Services for missed payments.

 

8. Subscriptions and Recurring Services

Certain Services may be offered on a recurring subscription basis.

Subscription terms, billing frequency, renewal terms, cancellation procedures, and pricing will be disclosed at the time of purchase.

Unless otherwise stated, subscriptions continue until cancelled.

Cancellation stops future billing but does not entitle you to refunds for prior payments.

 

9. Scheduling, Rescheduling, and Attendance

For live sessions, coaching calls, workshops, or consultations:

• You are responsible for attending scheduled sessions on time.
• You are responsible for having a reliable internet connection and appropriate technology.
• Missed sessions may be forfeited unless otherwise stated in the applicable Service terms.

Specific cancellation and rescheduling policies may vary by Service and will be communicated at the time of purchase.

 

10. Refunds

Refund policies may differ depending on the Service purchased.

Unless otherwise required by law, refunds, cancellation rights, guarantees, and payment obligations are governed by the terms disclosed on the applicable sales page, checkout page, proposal, invoice, or written agreement.

If no refund policy is stated for a particular Service, all purchases are final.

 

11. Community Conduct

If a Service includes access to a community, group program, forum, chat, membership area, or similar environment, you agree to behave respectfully and professionally.

You may not:

• Harass or abuse other participants
• Engage in discrimination or hate speech
• Share confidential information belonging to others
• Spam, solicit, or promote unrelated products or services
• Disrupt the learning environment

Violation of these standards may result in removal without refund.

 

12. Confidentiality

I will treat information you share as confidential and use it solely for delivering the Services.

However, confidentiality does not apply where disclosure is required by law or reasonably necessary to prevent fraud, illegal activity, or imminent harm.

Unless separately agreed in writing, participation in the Services does not create a formal non disclosure agreement (NDA).

 

13. Intellectual Property

All content and materials provided through the Services remain the exclusive property of Midlife Founders and Sven Elstermann.

This includes, without limitation:

• Frameworks
• Templates
• Worksheets
• Training materials
• Presentations
• Videos
• Recordings
• Documents
• Resources
• Written content

You receive a limited, personal, non transferable, non exclusive license to use the materials for your own personal or business purposes.

You may not:

• Copy
• Reproduce
• Republish
• Resell
• Distribute
• Modify
• License
• Commercially exploit

any portion of the Services without prior written permission.

 

14. Client Content

You retain ownership of content you submit through the Services, including applications, worksheets, assignments, messages, and submissions.

You grant Midlife Founders a limited license to use such content solely for delivering, administering, and improving the Services.

 

15. Recordings

Calls, workshops, group sessions, or trainings may be recorded.

By participating in recorded sessions, you consent to being included in such recordings.

Recordings may be used for:

• Participant access
• Internal quality improvement
• Program delivery

Recordings may not be copied, distributed, or shared publicly without written permission.

 

16. Testimonials

If you provide feedback, testimonials, reviews, success stories, or results, I may request permission to use them for marketing purposes.

I will not knowingly publish personally identifying information without your permission.

Anonymous feedback may be referenced in aggregate form.

 

17. AI Generated Content

Certain Services may incorporate artificial intelligence tools, software, or workflows.

AI generated outputs may contain inaccuracies, omissions, or errors.

You agree to independently evaluate any recommendations, insights, reports, summaries, or outputs before relying upon them.

AI generated content should not be treated as legal, tax, financial, medical, or other professional advice.

 

18. Third Party Platforms

The Services may rely on third party platforms including but not limited to:

• Kajabi
• Stripe
• Zoom
• Google Workspace
• OpenAI products
• Other software providers

I am not responsible for outages, interruptions, errors, security incidents, or service failures caused by third party providers.

 

19. Acceptable Use

You agree to use the Services lawfully and respectfully.

I reserve the right to suspend or terminate access without refund if you:

• Violate these Terms
• Engage in abusive behavior
• Infringe intellectual property rights
• Interfere with the operation of the Services
• Engage in fraudulent or unlawful activity

 

20. Limitation of Liability

To the fullest extent permitted by law, Midlife Founders and Sven Elstermann shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes loss of:

• Revenue
• Profits
• Clients
• Data
• Business opportunities
• Goodwill

My total liability arising from any claim relating to the Services shall not exceed the amount you paid for the specific Service giving rise to the claim during the twelve months preceding the claim.

 

21. Indemnification

You agree to indemnify and hold harmless Midlife Founders and Sven Elstermann from claims, liabilities, losses, damages, costs, and expenses arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any law or third party rights

 

22. Force Majeure

I shall not be liable for delays or failure to perform resulting from causes beyond my reasonable control, including:

• Internet outages
• Platform failures
• Natural disasters
• Government actions
• Illness
• Labor disputes
• Power outages

If such events occur, I may reschedule, delay, modify, or cancel Services as appropriate.

 

23. Privacy

Your use of the Services is also governed by the Privacy Policy, which explains how personal information is collected, used, stored, and protected.

 

24. Electronic Communications

By using the Services, you consent to receive communications electronically, including emails, invoices, receipts, notices, and other communications related to the Services.

 

25. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California, except where small claims court jurisdiction applies.

Both parties agree to bring claims only in their individual capacities and not as part of any class action or representative proceeding.

 

26. Changes to Terms

I may update these Terms at any time.

Updated Terms will be posted with a revised “Last Updated” date.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

 

27. Termination

I reserve the right to suspend or terminate access to the Services at any time if you violate these Terms or engage in conduct that is harmful to me, the Services, or other participants.

Termination does not eliminate any payment obligations already incurred.

29. Entire Agreement

These Terms, together with the Privacy Policy and any specific terms disclosed for a particular Service, constitute the entire agreement between you and Midlife Founders regarding the Services and supersede all prior discussions, understandings, and agreements.
